What if you were injured while on the job, do you have a claim?
Let’s look at the law at work. Many of you may be familiar with the fact that you may be able to make a claim for worker’s compensation benefits if you are injured at work. Did you know that you may also have what is known as a third party claim?
Let’s assume that you are delivering flowers in the company truck. On the way, you are rear ended by an even bigger truck. How do you know if you have a claim against the truck driver that struck you in the rear?
1.If you were injured as a result of another driver’s negligence, then you have a claim against that driver. Even though you were in the course of your employment, you may still pursue a claim against the third party who caused the accident.
2.In many states, worker’s compensation insurance will only pay for your medical bills, lost wages, permanent injury rating, and, under some circumstances scarring. However, additional compensation for pain and suffering may be recovered by the at fault driver in our example.
