After Alice Chandler was killed in a motorcycle accident, her mother came to us for help.
Alice had been a passenger on her boyfriend’s bike when he lost control and they were both killed. There was only $20,000 minimum coverage on the motorcycle and the insurance company had already offered that to Alice's mother.
She was unable to support herself and the $20,000 would not go very far. We told her that we would try to find her some additional sources of income.
Our extensive investigations revealed two very important facts. First, Alice's boyfriend had been served drinks at two bars prior to the accident. This enabled us to pursue claims against the two bars under the Dram Shop Law.
Second, we learned that Alice had been living with her maternal grandmother at the time of the accident and the grandmother owned a car. That opened the possibility that we might make a claim against the grandmother's Underinsured Motorist coverage.
Ultimately, we raised our clients’ recovery to $138,000 and structured the payments so she would get a monthly income for the rest of her life.
