In the summer of 1995, Nancy Caldwell* was a passenger on an uninsured motorcycle when the motorcycle struck the rear of a car. Nancy sustained a fracture of the clavicle, lingering neck and back pain and substantial medical bills.
Unfortunately, the motorcycle was not insured, nor did Nancy have motor vehicle insurance herself. Although Nancy had her own apartment, she lived with her parents a few nights a week. Accordingly, the Haymond Law Firm made a claim for benefits under her parent's policy. It was our argument that as a resident in her parent's household, she was entitled to coverage under their Allstate policy. Allstate denied coverage, claiming that Nancy resided in her apartment, and not with her parents. Our Attorney persisted, maintaining the one legal residence. Although Allstate continued to deny coverage, they agreed to pay a six-figure settlement rather than try the case.
